Welcome to Visual Edge (“Visual Edge,” “we,” “our,” or “us”). These Terms & Conditions govern your use of our website (https://visualedgetx.com) and all services we provide, including photography, videography, drone operations, floor plans, virtual tours, editing, and digital media delivery.
By booking services, using our website, or communicating with us, you agree to these Terms.
1. Copyright & Media Usage Rights
All photos, videos, floor plans, and media created by Visual Edge remain our intellectual property and are protected by U.S. copyright law.
We grant the original paying client a non-exclusive, non-transferable license to use the media solely for marketing the specific property for which it was created.
This license:
- Applies only while you actively represent the property
- Cannot be transferred, resold, or given to other parties (e.g., stagers, builders, other agents)
- Does not permit alterations that materially change the media without written approval
- Requires written permission for any use beyond the original purpose (e.g., portfolio use, builder promotions, long-term marketing)
2. Property Readiness
Properties must be photo-ready at the time of the appointment. Visual Edge does not provide cleaning or staging services.
If the property is not ready, a reshoot or return trip may incur a fee.
3. Access to Property
Clients must provide correct access details (codes, lockboxes, keys, or on-site contact).
If we are unable to access the property due to incorrect information or no-shows, a trip fee may apply.
4. Weather Policy
We shoot in most weather conditions except when safety or image quality is significantly impacted.
In cases of storms or unsafe flying conditions for drones, we will reschedule at no charge.
Cloudy weather is not grounds for cancellation. Sky replacement is available as an optional add-on.
5. Editing & Revision Policy
Each shoot includes one round of basic editing.
Additional revision requests may incur a reasonable editing fee.
6. Cancellations & Rescheduling
Please provide at least 24 hours’ notice for cancellations or rescheduling.
Same-day cancellations, missed appointments, or failure to provide property access may result in a cancellation or trip fee.
7. MLS Compliance
Clients are responsible for ensuring that media complies with their local MLS rules.
Floor plans are approximate and for marketing purposes only. They should not be used for measurements, valuations, or appraisals.
8. Limitation of Liability
Visual Edge is not liable for:
- Delays caused by weather, illness, or technical issues
- Lost business or indirect damages
- Access problems caused by inaccurate client information
- Temporary outages of media delivery platforms
Our total liability is limited to the amount paid for the specific service in question.
9. Indemnification
By booking our services, you affirm that you have permission to photograph and publish the property.
You agree to indemnify and hold Visual Edge harmless from any claims, damages, or legal fees resulting from unauthorized entry, photography, or distribution of media.
10. Payment Terms & Licensing Conditions
Payment is due as specified during booking.
Usage rights are granted only upon full payment.
Visual Edge reserves the right to revoke access or usage rights in the event of non-payment.
11. SMS/Text Messaging Policy (A2P 10DLC Compliant)
By providing your phone number, you consent to receive SMS messages from Visual Edge Real Estate Media for:
- Appointment confirmations
- Arrival and completion notifications
- Media delivery updates
- Service-related communication
- Occasional promotional offers (only if opted-in)
Message frequency varies. Message & data rates may apply.
How to Opt Out
You may opt out at any time by replying:

We do not sell or share your phone number with third-party marketers.
12. User Responsibilities
You agree not to misuse our website or services, including but not limited to:
- Uploading harmful or illegal content
- Attempting unauthorized access
- Interfering with website functions
- Violating privacy or intellectual property rights

We do not guarantee indefinite storage; clients are responsible for downloading and backing up their media files.
